1. Acceptance of these terms
By accessing or using a Toumiō Labs public website, product or service that refers to these Terms of Use, you agree to follow these terms and any additional terms presented for that service. If you do not agree, do not use the relevant service.
2. Eligibility
You may use the services only if you can form a binding agreement under the law that applies to you and are not prohibited from using them. If you use a service for an organization, you represent that you are authorized to accept these terms for that organization.
3. Toumiō Labs services
Toumiō Labs builds AI products, interfaces, workflows, voice systems, developer tools and related infrastructure. The public website provides information about this work. Features, models, providers, limits and availability may vary by product and may change over time.
4. MoCHi and Haven
MoCHi is a personal AI workspace for multi-model access, BYOK, memory, projects, files, search, voice, image tools, charts, customization and developer workflows. Haven is voice and TTS infrastructure in development for natural AI speech, Read Aloud and future real-time voice experiences. Product-specific terms may supplement these terms.
5. User accounts
If a product requires an account, you are responsible for providing information that is accurate enough for the service, protecting your credentials and activity, and promptly reporting suspected unauthorized use. Toumiō Labs has not made a general promise about account features, authentication methods or account retention on this public website; review the product-specific information provided at sign-up.
6. BYOK and third-party providers
MoCHi may allow you to connect third-party AI providers using your own API keys. You are responsible for having the right to use each key, complying with the provider’s terms and acceptable-use rules, and understanding any provider charges or limits. Requests and content sent to a third-party provider are governed by that provider’s terms and privacy policy. Do not connect keys or submit content that you are not authorized to use.
7. User responsibilities
You are responsible for your use of the services and for reviewing outputs before relying on them. Do not use the services to violate law or another person’s rights, interfere with the service, evade access controls, introduce malicious code, or build a competing service from protected materials without permission.
8. Acceptable use
You may not use the services to impersonate people or organizations, facilitate fraud, abuse, harassment, unlawful surveillance, unauthorized access, distribution of malware, or other harmful or illegal activity. You may not probe, scan or test the service for vulnerabilities without written permission.
9. Intellectual property
Toumiō Labs and its licensors retain rights in the site, products, software, designs, names, marks, documentation and other materials supplied by Toumiō Labs. These terms give you a limited, non-exclusive, non-transferable right to use the services as made available to you. No ownership is transferred to you.
10. User content
You retain rights you already have in content you submit or connect to a service. To provide the requested functionality, you grant Toumiō Labs the limited permissions reasonably necessary to receive, process, display, transmit or store that content within the relevant service. Do not submit content unless you have the rights and permissions needed for this use. Product-specific documentation should explain any additional content practices.
11. Third-party services
Services may link to or interoperate with third-party providers, including AI model, storage, voice, payment or hosting providers. Toumiō Labs does not control those services and is not responsible for their content, policies, availability or actions. Your use of them is subject to their own terms and privacy policies.
12. Availability and changes
We may add, remove, suspend or change features, providers, limits or entire services. We do not promise that a service will be available at all times, remain unchanged, or be free of errors. We will try to provide reasonable notice for material changes where practical.
13. Experimental and beta features
Features labeled experimental, preview, beta, research or coming soon may be incomplete, unstable or changed without notice. Use them only for appropriate testing and do not rely on them for critical decisions or time-sensitive operations unless the relevant product terms say otherwise.
14. Disclaimers
To the maximum extent permitted by applicable law, the services are provided on an “as available” and “as is” basis. Toumiō Labs disclaims warranties not expressly stated in these terms, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and availability. AI outputs can be incomplete, inaccurate or unsuitable for a particular use; you are responsible for evaluating them.
15. Limitation of liability
To the maximum extent permitted by applicable law, Toumiō Labs and its licensors, providers and contributors will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, data, revenue or business opportunity, arising from or related to the services. This section does not limit liability that cannot legally be limited.
16. Termination
You may stop using a service at any time. Toumiō Labs may suspend or end access, or discontinue a service, if it is necessary for security, law, misuse, non-payment where applicable, operational reasons or a product change. Sections that by their nature should continue, including intellectual property, disclaimers, limitations and dispute-related provisions, will continue as permitted by law.
17. Changes to these terms
We may update these terms as the site and products evolve. The “Last updated” date above indicates when this page was most recently reviewed. Continued use after an update means you accept the updated terms, unless applicable law requires another form of notice or acceptance.
18. Governing law and venue
TODO: confirm the governing jurisdiction and venue. Toumiō Labs should replace this placeholder with the governing-law and dispute-resolution provisions appropriate to its actual operating structure before relying on these terms for a broader commercial launch.
19. Contact
Contact method to be added: Toumiō Labs should publish a monitored email address or other reliable contact channel for questions about these terms and the services.
